Liquor policy: Delhi High Court upholds arrest of Chief Minister Arvind Kejriwal by CBI

The Delhi High Court on Monday dismissed a plea filed by Chief Minister Arvind Kejriwal challenging his arrest by the Central Bureau of Investigation (CBI) in a corruption case related to the liquor policy matter. Justice Neena Bansal Krishna, while disposing of Kejriwal’s bail plea, granted him liberty to approach the lower court for relief. It cannot be said that the arrest was made without any prior notice.

The court had reserved the order on the AAP leader’s bail plea on July 29 after hearing arguments from Kejriwal and the CBI lawyers. Challenging his arrest, Kejriwal’s counsel had argued that it was an “insurance arrest” to ensure that he remains in jail.

Describing his arrest as a “sham”, Kejriwal’s counsel had argued that the CBI did not want to arrest him and did not have any material to detain him, and the sequence of events made it clear that he was arrested to remain in jail.

The CBI counsel had opposed both the arguments of Kejriwal and said it was improper to call his arrest an “insurance arrest” and added that he was the mastermind of the excise scam and there was evidence to show his involvement in the crime.
